In view of the preliminary objection raised by the learned counsel for the respondents regarding the maintainability of the petition, on the ground that the challenge is to the order dated 29th November 2025 passed by the learned Joint Civil SQ Pathan 1/2

17-WP-16952-2025.doc Judge, Senior Division, Pune, the learned counsel for the petitioner seeks leave to withdraw the petition, with liberty to institute appropriate proceedings, as may be maintainable in law, before the appropriate forum/Court.

Petition is accordingly disposed of as withdrawn with liberty as prayed.

Needless to state that any delay, if caused in instituting such proceeding, the pendency of this petition, shall be taken into consideration by the appropriate forum/Court. We make it clear that we have not gone into the merits of the petition and as such all contentions of all parties on merits are kept open.
