Heard Learned Counsel for the Petitioner.

When the Court expressed its disinclination to entertain the Petition, the learned Counsel seeks leave to withdraw the Petition with liberty to institute a Suit to challenge the grant of the area by the impugned order of Unilateral Deemed Conveyance Certificate.

Since the grant of a certificate under Section 11 of the MOFA, does not preclude the aggrieved party from filing a Suit based on title, the Petition stands dismissed as withdrawn with liberty to avail the remedy of instituting a Civil Suit. [N. J. JAMADAR, J.] Arjun 1/1
