Heard learned Counsel for the Petitioner.

A limited grievance in this Petition is that the application filed by the Petitioner under Section 18 of MSMED Act, was rejected by the Facilitation council, Pune, with the remark, "documents not complete".

The learned Counsel for the Petitioner submits that the Petitioner was not provided an opportunity of hearing before the application came to be rejected. Nor any communication was addressed to the 1/2

Petitioner indicating the documents which the Petitioner was required to file.

In view of the aforesaid submissions, as the impugned order appears to have been passed on the Administrative side without providing an opportunity of hearing, the impugned order stands quashed and set aside.

5.

The Application filed by the Petitioner stands restored to the file of Facilitation Council.

6.

The Facilitation Council shall notify the documents which petitioner is required to file.

7.

In the event the Facilitation Council is not inclined to entertain the Application for non-filing of the documents and/or non removal of objections, 15 days clear notice be given to the Petitioner.

8.

Petition accordingly stands disposed of.
