Learned Counsel for the Petitioner submits that as the decree in question is not executable, the Petitioner has filed an application under Section 47 of the Code of Civil Procedure, 1908 before the Executing Court. 3.

If that is the case, there is no propriety in entertaining this Petition. 4.

The Writ Petition thus stands disposed with a request to the Executing Court to decide the application filed by the Petitioner under Section 47 of the Code, as expeditiously as possible.
