Dr.Uday Warunjikar a/w Mr.Sumit Kate, for the Petitioner. Smt.Ashwini A. Purav, AGP, for Respondent Nos.1,3,4,5,6 and 7 - State.

Mr.Mandar Limaye, for the Respondent No.2 - Thane Municipal Corporation.

CORAM:

SUMAN SHYAM & S. M. MODAK, JJ.

DATED:

23rd DECEMBER 2025.

PC:- 1.

Heard Dr.Uday Warunjikar, learned counsel appearing for the Petitioner, Smt.Ashwini Purav, learned AGP for Respondent Nos.1,3,4,5,6 and 7-State and Mr.Mandar Limaye, learned counsel appearing for Respondent No.2 - Thane Municipal Corporation. 2.

Being aggrieved by the order dated 11th September 2025 passed by the Respondent No.5 and the order dated 27th May 2025 passed by the Respondent No.3 and the notice dated 29th September 2025 issued by the Respondent No.4 confirming the show cause notice issued by the Respondent No.2, the Petitioner had preferred a Revision Application before the Respondent No.6

on 12th Novmeber 2025 which is pending disposal. Aggrieved due to the non-consideration of the Revision Application as well as the prayer for interim relief, the Petitioner has approached this Court by filing the present Petition.

3.

Dr.Warunjikar, learned counsel for the Petitioner submits that taking advantage of the absence of any interim order, the Respondent No.7 is proceeding with the implementation of the impugned order. If the same is permitted, then it will render the Revision Application as infructuous. As such, an order of interim protection is called for in this case.

4.

On the last date, we had adjourned the matter so as to enable Ms.Ashwini Purav, learned AGP, to seek instructions. Today, when the case is called out, she submits, on instructions, that due to the election process, the Respondent No.6 has not been able to take up the Revision Petition. However, as soon as the election process is over, an attempt will be made to dispose of the Revision Application preferred by the Petitioner. If that be so, we do not find any justifiable ground to keep the Writ Petition pending any further. The same is accordingly disposed of by providing that the Revision Application be disposed of by a reasoned order, as expeditiously as possible, preferably within a period of six (6) months from the date of receipt of the certified copy of this order.

5.

Taking note of the apprehension expressed by the Petitioner, ad-interim relief in terms of prayer clauses (b), (c) and (d) is hereby granted, till disposal of the Revision Application. 6.

The Writ Petition stands disposed of accordingly. (S. M. MODAK, J.) (SUMAN SHYAM, J.)
