CIVIL APPELLATE JURISDICTION WRIT PETITION NO.17095 OF 2025 Dinesh Lachhmandas Rajpal ...
Petitioner Vs.
Indian Bank and another ...
Respondents Mr. Ashif Husain a/w. Mr. Huzer Qureshi for Petitioner. CORAM : MANISH PITALE & SHREERAM V. SHIRSAT, JJ.
DATE : APRIL 17, 2026 P.C. :
.
The petitioner is an auction purchaser, who has approached this Court for a limited direction to the Debts Recovery Tribunal-II, Mumbai (DRT-II) to decide pending Interim Application No.1940 of 2025 in Securitisation Application No.176 of 2021 at the earliest. 2.
Mr. Husain, learned counsel appearing for the petitioner informs this Court that pendency of the proceedings before DRT-II is causing grave prejudice to the petitioner, and that therefore, this Court may consider issuing appropriate direction for disposal of the pending proceedings at the earliest.
3.
Although this petition is listed before this Court for the first time, we are of the opinion that expeditious disposal of all the pending proceedings would be in the interest of all the concerned parties. Hence, issuance of notice is dispensed with.
4.
Considering the workload before DRT-II, Mumbai, we are inclined to grant reasonable time for disposal of the pending proceedings.
