After hearing the submissions of Mr. Anturkar, the learned Senior Counsel appearing for the Petitioners as well as Mr. Surel Shah, the learned Senior Counsel for the Respondent No.1, we are of the view that learned AGP should be asked to obtain instruction and apprise this Court as to whether, the engagement of the Repondent No.2 i.e. the recruitment agency, was in place on the date on which it had reportedly conducted the written examination 23rd December 2025

61 WP 17315.25.DOC and if so, if the said Respondent No.2 has any further role to play in the recruitment process as on date. The clarification is deemed necessary in view of the order dated 14th November 2025 (Coram: Anil S. Kilor and Rajnish R. Vyas, JJ) passed by the Nagpur Bench of the Bombay High Court.

The learned AGP to also seek instructions and apprise this Court, if any action has been taken on the representation dated 11th November 2025 (Exhibit 'H') submitted by the Petitioner No.1. 3.

As an ad-interim measure, it is provided that the Respondent No.1 may continue with the recruitment process, if so advised, but shall not issue any order of appointment until the next date. 4.

The issue of maintainability of the Writ Petition is kept open and will be considered on the next date.
