This Petition was circulated on the ground of the urgency as mentioned in the praecipe dated 26th December, 2025. 2.

Heard Mr. Uday Warunjikar (Through VC) and Mr. Bhushan Deshmukh (present in Court), learned Advocates for Petitioners, Mr. Nikhil Rajani, learned Advocate for the Respondent No.1 and Ms. Kavita Solunke, Additional Government Pleader for Respondent - State. 3.

Mr. Uday Warunjikar, learned Advocate for the Petitioners submits that as per notice dated - Respondents would take possession of the subject property on 29th December, 2025. Gayatri Shimpi

Mr. Nikhil Rajani, learned Advocate for Respondent No.1 points out to the various orders passed by this Court, including the order dated 23rd July, 2025 passed in Writ Petition (ST) No. 24722 of 2025, by which this Court had taken note of the delay in disposal of the proceedings under Section 14 of SARFAESI Act, 2002. He submits that the amount due from the Petitioners as on 31st August, 2025, was Rs. 48.75 crore and the said amount has further increased as on date. He tenders order dated 17.10.2025 passed by the Appellate Authority dismissing the proceeding bearing I.A. No. 516 of 2024 and Misc. Appeal Dy. No. 274 of 2024 for non-compliance of the conditional order dated 16.09.2025, the same is taken on record and marked as 'X' for identification.

Faced with the above said situation, Mr. Uday Warunjikar, learned Advocate for the Petitioners, requests for a short adjournment in the matter to take instructions from the Petitioners, as to whether Petitioners can deposit a substantial amount of not less than Rs. 10 crore, in this Court, so as seek indulgence from this Court. 6.

At the request of Mr. Uday Warunjikar, learned Advocate for the Petitioners and by consent of the parties, list the matter on 27th December, 2025.
