In this Writ Petition the challenge is to the legality and validity of the order dated 11th December 2025 passed by the learned Judge of the Family Court, Mumbai below Exhibit-17 in Petition No.D-85 of 2025. The operative part of the said order reads as under :-

ORDER

1. Application (Exh.17) is partly allowed.

2 Respondent-mother is hereby directed to give compensatory video call access of the son 'Ethan' to the petitioner-father on Thursday of the week

24-CIVIL WP-17416-2025.DOC Akash Tayde between 06.00 pm to 07.00 pm as per clause 3 of above order.

3. Respondent-mother is hereby directed to give physical access of the son 'Ethan' to the petitionerfather on the forthcoming Christmas, i.e. 25.12.2025, for one hour between 7.00 p.m. to 8.00 p.m at 'SkyCity Mall', excluding the travelling time of petitioner.

4. Both parties are directed to co-operate each other for peaceful and smooth access.

5. Any unjust disobedience of this order shall ensue strict adverse action against the defaulting party.

6. No order as to costs.

Thus, what has been directed by the impugned order granting one hour physical access to the Respondent-Father on the day of Christmas i.e. 25th December 2025 in between 7.00 p.m. to 8.00 p.m. at Sky-City Mall, excluding the travelling time. It is settled legal position that it is the right of the child to get love and affection from both the parents.

Accordingly, no interference in the impugned order dated 11th December 2025 passed by the learned Judge of the Family Court, Mumbai below Exhibit-17 in Petition No.D-85 of 2025 is warranted. The Writ Petitions is dismissed, however, with no order as to costs.
