Learned Counsel for the Petitioners, on instructions, seeks leave to withdraw the Petition with liberty to file a fresh application for temporary injunction, in the event the application for amendment preferred by the Petitioners/Plaintiffs before the Trial Court is allowed. 3.

Leave granted with liberty as prayed for.

By way of abundant caution, it is clarified that the application for amendment shall be decided by the Trial Court on its own merits and in accordance with law, and, the withdrawal of the Writ Petition, subject to the said liberty, may not be construed as an expression of opinion as regards the merits of the said application for amendment, which shall be decided by the Trial Court as expeditiously as possible.
