According to the Petitioners, the reliefs sought are covered by the decision of the Apex Court in case of Rohan Vijay Nahar vs. State of Maharashtra, 2025 SCC OnLine 2366.

However, we deem it appropriate to issue notice to the Respondents and seek their response.

The learned AGP waives notice on behalf of Respondent Nos.1 to 6. She is directed to file Affidavit of the Forest Department, who is the contesting Respondent in the Petition. Let the Reply Affidavit be filed within a period of four weeks. Re-notify to 04/03/2026.
