The Petitioner had a Mahadev Koli Scheduled Tribe certificate. However, considering the law laid down by this Court at the Aurangabad Bench in Prakash Subhash Bhople v/s. Deputy Collector (General), Latur and Ors.1 and the Hon'ble Supreme Court in State of Maharashtra and Ors. v/s. Milind Sharad Katware and Ors.2, the Petitioner had to seek a corrected tribe certificate, with the tribe properly mentioned as 'Koli Mahadev'.

The concerned Deputy Collector has called upon the Petitioner to comply with the procedure as is required for the purpose of issuing a corrected tribe certificate mentioning the correct tribe name as 'Koli Mahadev'.

The learned Addl. GP submits that if the procedure is completed, the concerned Authority would issue the certificate within a period of three weeks. If the procedure is not complied with, the Petitioner shall complete the procedure and, within three weeks thereafter, the correct certificate would be issued. 4.
By recording the above statement, this Petition is disposed off.

Liberty is granted to the Petitioner to approach the Committee for seeking an attested copy of the original Mahadev Koli certificate which has been confiscated. If the Petitioner produces an attested copy of the incorrect tribe certificate, Respondent No.2 would verify whether the original certificate has been confiscated by the Caste Scrutiny Committee. If the original
certificate is in the file of such Committee, then Respondent No.2 will act on the attested copy of the certificate. (ABHAY J. MANTRI, J.) (RAVINDRA V. GHUGE, J.)
