According to the petitioner, the order passed by the Deputy Registrar of Co-operative Societies in exercise of powers under Section 154B-20 of the Maharashtra Co-operative Societies Act, 1960, is without jurisdiction.

It is contended that the order has been passed against the Director and not against the company, which is the member of the society. Such contention involves a mixed question of law and fact, which is required to be raised and adjudicated before the Revisional Authority.

Hence, all questions raised on merits in the present petition are kept open to be agitated in the revision application.
