This matter was heard on 26.12.2025 and 27.12.2025. On 27.12.2025, the matter was adjourned to afford an opportunity to the learned APP for the State to take instructions with regards the time period for disposal of the Appeal filed by the Petitioner under Section 60 of the Maharashtra Police Act, 1951. 2.

Today, Ms. Prajakta Shinde, learned APP for the State on instructions submits that the Appeal filed by the Petitioner under Section 60 of the Maharashtra Police Act, 1951, shall be decided and disposed of by the Appellate Authority within a period of one week from today. Statement made by Ms. Prajakta Shinde, learned APP for the State is accepted.

Ms. Prajakta Shinde, learned APP for the State by referring to Gitalaxmi

26-WP-17598-2025.doc the Maharashtra Municipal Corporation Act, 1949, more particularly Schedule-D, Chapter-I (Election Rules) points out to Rule 9(3), to submit that the nomination papers can be filed even by the proposer or seconder. She by relying on the said provision further submits that in the event the Petitioner intents to file his nomination papers, he can take recourse to the aforesaid provisions.

In view of the statement made by Ms. Prajakta Shinde, learned APP for the State, Mr. Mohammad Ibraheem, learned Advocate for the Petitioner submits that the grievance of the Petitioner is presently resolved and this the present Petition can be disposed of.

Appeal filed by the Petitioner under Section 60 of the Maharashtra Police Act, 1951, be decided on or before 05.01.2026. 6.
