The hearing in this Petition has been conducted through the video conferencing mode from the Chiplun Taluka Court. 2.
The learned Advocate for the Petitioner has addressed the Court through video-conferencing mode for a considerable time. His contentions can be summarised as under:-
a) The Petitioner was a resident of the Chhawni area in Chhatrapati Sambhaji Nagar City;
b) In 2008, he purchased land in an area known as 'Mitmita', which falls within the Municipal Corporation limits;
c) After purchasing the land, the Petitioner started shifting his business to the Mitmita area;
d) His residence has also been constructed in Mitmita; e) On 15/12/2025, he sought deletion of his name from the Chhawni area/ward and requested that his address of the Mitmita residence be mentioned. On the same day, i.e. 15/12/2025, his name was deleted from the State Legislative Assembly electoral rolls of the Chhawni area; g) His name does not appear in the ward at Mitmita for the purpose of exercising his right to vote in the ensuing Corporation elections;
h) For the Municipal Corporation elections, the Legislative Assembly electoral rolls as on 01/07/2025, have been taken into account.

Prima facie, in my view, the Petitioner has not been diligent. No relief can be granted in this Petition. In the event his name appears in the ward in which Chhawni area falls, considering that the Municipal Corporation voters list has been finalised on the basis of the State Legislative Assembly list as existing on 01/07/2025, he would be at liberty to vote in Chhawni area. 4.
The learned Advocate for the Petitioner submits, on instructions, that this Petition may be disposed off as withdrawn, on instructions.

In view of the above, this Petition is disposed off as withdrawn, on instructions.
