The petitioner is aggrieved by the award of work in favour of the respondent no.3-M/s Maharashtra Enterprises. The learned counsel for the petitioner-Firm submits that the respondent no.3 has been awarded the subject work only on account of the said entity being situated at Navi Mumbai. However, we do not find any such stipulation in the tender document. The final selection has been made on the basis of grading of the bidders on technical and financial evaluation vide Exhibit-D. The petitioner-Firm was awarded 90 marks in technical evaluation whereas respondent no.3 has been awarded 100 marks. Similarly, the petitioner-Firm was though awarded 100 marks in financial evaluation, the respondent no.3 has scored 96.4 marks and the cumulative marks obtained by the respondent no.3 is

BDP 19 WP-17850-25.doc higher than the petitioner-Firm. Thus, we do not find any infirmity in the decision making process of the respondent nos. 1 and 2. 2.

Writ Petition No.17850 of 2025 is dismissed.
