Learned Counsel appearing for the Appellant submits that the First Appeal has been wrongly filed as the challenge is to the compensation awarded / paid under the National Highways Authority . Act, 1956 which does not provide for remedy of an Appeal and seeks permission to withdraw the Appeal.

First Appeal is permitted to withdrawn with liberty to adopt appropriate remedy. Refund of Court fees as per Rules. 3.

In view of the withdrawal of First Appeal, nothing survives for consideration in the pending civil/interim applications and the same stand disposed of.
