By the impugned order the Joint Charity Commissioner, Kolhapur has directed the Trust i.e. opponent No.1 to amicably celebrate the customary festival with the participation of applicant and opponent. 3.

It is contention of learned counsel for the appellants that the appellants had not pressed the interim application before learned Joint Charity Commissioner (Exhibit-B) then also learned Joint Charity Commissioner has passed order which is erroneous. Though the respondents have filed caveat but none present for respondents after service of notice.
