CORAM
: KISHORE C. SANT, J.
DATE : 17.10.2025 PC :- 01.
This appeal is urgently moved before this Court for continuation of ad-interim relief granted by this Court by order dated 04.09.2025. The appeal was initially filed as a Civil Revision Application, when the ad-interim relief was granted. On 14.10.2025, this Court noticed that Civil Revision Application is not maintainable in view of amended Section 83, sub-section (9) of the Wakf Act and allowed to covert the Civil Revision Application into First Appeal. 02.
Learned Sr. Advocate Mr. Katneshwarkar vehemently opposes continuation of ad-interim relief. He submits that while granting adinterim relief, no party was heard except the appellant. The matter is expedited by the Hon'ble Supreme Court. Granting stay would be against the order of Hon'ble Supreme Court expediting the matter. He is also ready to argue the matter on merit.
( 2 ) fa2825.25 03.
Objection is also raised for continuation of ad-interim relief, as no specific Civil Application for stay has been filed. 04.
This Court would not go in into said technicality. Today being last working day before Diwali Vacation, this Court is not in a position to hear this matter on merit.
05.
Since there is ad-interim relief already granted, same shall continue till next date.
06.
Stand over to 03.11.2025.
