Juliet Rodrigues E Noronha Thr. Poa Alwyn Fernandes And 4 ORS v. Christophor Marshal Rosario And 15 ORS
2 AO 6 2026 Meena
IN THE HIGH COURT OF BOMBAY AT GOA
APPEAL FROM ORDER NO.6 OF 2026 JULIET RODRIGUES E NORONHA THR.
POA ALWYN FERNANDES AND 4 ORS ... APPELLANTS
Versus
CHRISTOPHOR MARSHAL ROSARIO AND 15 ORS ... RESPONDENTS Mr. Gajendra Usgaonkar, Advocate for the Appellants. CORAM:- VALMIKI MENEZES, J.
DATED :- 12th March, 2026 P.C.:
1. Registry to waive office objections and register the matter.
2. The challenge in this appeal is to an appellate order of the District Court. The original order of the trial Court, dated 29.11.2019, dismissed the Appellants' application objecting to certain assets listed in the inventory proceedings. These objections are under Section 400 of the Goa Succession Act. Against that order, the Appellant preferred an appeal under subsection 2 of Section 451 of the said Act, which was dismissed by the District Court on 27.03.2025. Considering this position, there is no further appeal provided against the appellate order, and the only remedy for the Petitioner is to file a Writ Petition. 12th March, 2026
2 AO 6 2026
3. Considering this position, this appeal is not maintainable. Consequently, the appeal stands dismissed as not maintainable. However, in view of the fact that the wrong proceeding was filed, leave is granted to the Appellant to file a Writ Petition by paying the appropriate Court fees.
