This appeal is urgently moved as according to the appellant, there was a threat of demolition. The suit is filed to challenge the letters issued by Mumbai Metropolitan Region Development Authority allotting alternate premises to the appellant in lieu of the premises 1/2
502.205.25 ao.docx occupied by the appellant which is affected by the road widening scheme. The suit filed by the appellant is not based on any declaration of title to the land affected by the road widening scheme. In any event, alternate premises is already offered to the appellant and the same is challenged by the appellant.

Learned counsel for the appellant is unable to point out any right in favour of the appellant in respect of the land affected by the road widening scheme.

Hence, ad-interim relief cannot be granted at this stage. 5.
In view of the aforesaid, there is no prima facie case in favour of the appellant. The appellant cannot be permitted to stall the road widening scheme.

The appeal is, therefore, dismissed.

In view of dismissal of appeal, Interim Application No. 6566 of 2025 is disposed of as infructuous.
