Heard Mr. Abhyankar, learned Advocate for Appellants and Mr. Kanade, learned Advocate for Respondent Nos.1 and 2. 2.

After hearing Mr. Abhyankar, I expressed my mind that I am not inclined to interfere with the impugned order. Hence Mr. Abhyankar would persuade the Court to expedite the suit proceedings before the Trial Court. The learned Trial Court is directed to expedite the hearing of suit.

L. C. Suit No.3337 of 2016 has been filed by Defendants represented by Mr. Abhyankar who are Plaintiffs therein. Cause of action in that suit, prima facie, also overlaps certain reliefs in the

28.AO.569.2025+.doc present suit before Trial Court which are also sought for by Plaintiffs herein.

I am also informed that after filing of written statement, no further steps have been taken in that suit.

In that view of the matter, learned Trial Court can consider expediting both suits. If required parties are at liberty to move appropriate application for hearing both suits together in accordance with law.

With the above directions, Appeal from Order is disposed. In view of disposal of Appeal from Order, Interim Application is also disposed.
