Heard Mr. Mehta, learned Advocate for Appellant and Mr. Kanade, learned Advocate for Respondents.

Both the learned Advocates at the Bar jointly inform the Court that Notices of Motion in which the impugned ad-interim orders have been passed which are the subject matter of present twin Appeals from Order (AOs) before me are kept for hearing on 20.11.2022. Since

challenge is maintained to the ad-interim order without even Defendants having filed their affidavit in reply to the Motions, it would be appropriate if pleadings in the Motions are completed by parties and learned Trial Court disposes of both the Motions in accordance with law.

Both the learned Advocates agree to the aforesaid proposition and suggestion made by Court. Appellant who is Defendant before the Trial Court shall file its affidavit in reply to the Motions within a period of two weeks from today and Plaintiff before the Trial Court shall file its rejoinder within one week thereafter. 4.

Learned Trial Court is requested by this Court to dispose of Notice of Motion in both the matters within a period of three weeks from the date of filing of rejoinder after hearing both the sides by passing a reasoned order.

This Court has not expressed any opinion on merits either on facts or law. All contentions of both the parties are expressly kept open. Learned Trial Court shall not be influenced by any of the observations and findings in the ad-interim order while disposing of the Motions.

In the meanwhile, ad-interim relief shall continue.

With the above directions, both the Appeals from Order are disposed.
