The appellant is the original defendant. The suit was filed by the plaintiff for specific performance and came to be decreed ex parte in the absence of written statement. The defendant, therefore, challenged the said decree before the Appellate Court. The Appellate Court dismissed the appeal. Hence, the appellant has preferred the present appeal challenging the order passed by the Appellate Court.

Learned counsel for the respondent has filed a caveat and waives service of notice on behalf of the respondent. 3.
The appellant is directed to supply the copy to the defendant.
