Mr. Shyam Jawale, holding for Mr. Akshay Kulkarni informs that the matter is amicably resolved amongst the appellants and the respondents, whereby, the consent terms and conditions are agreed to, by both the parties. The appellant Rameshwar and Eknath are present before this Court and they are identified by Mr. Jawale, appearing for the appellants. The consent terms are placed on record and marked as "X" for the purpose of identification. The learned counsel Mr. Mahesh Muthal also confirms the consent terms and conditions being signed by both the parties to the dispute.

In view of the consent terms, the learned counsel for the appellants, upon instructions, seeks permission to withdraw the second appeal.

Permission granted. The Second Appeal stands disposed of as withdrawn. The parties to act accordingly in terms of the consent terms.
