Heard Mr. Madde, learned counsel for the appellant as well as Mr. Kawade, learned advocate for the respondent sole. 2.
Mr. Madde, submits that the matter was referred for mediation to Shri N.B. Khandare and in the mediation, the matter is amicably settled between the parties. The terms and conditions agreed between the parties are placed alongwith the mediation report. The same is taken on record and marked "X" for identification. 3.
In view of the compromise terms and conditions agreed between parties, the appellant does not want to pursue the present appeal.

The second appeal is thus disposed of as withdrawn in terms of the Compromise terms and conditions. Parties to act in terms of the compromise. The appellant shall be entitled to withdraw the court fees as per Rules. The appeal stands disposed of accordingly. Pending Civil application, if any, stands disposed of.
