In this Public Interest Litigation, the petitioner no.1, which is a hawkers' union and petitioner nos.2 and 3 are its President and Vice President, have assailed the validity of the impugned notification dated 26th March, 2025 issued by the Thane Municipal Corporation by which the final voters' list of vendors eligible to participate in the election of Town Vending Committee of Street Vendors has been published. 2.

Learned counsel for the respondent no.2 has produced a copy of the communication dated 4th April, 2025 issued by the Additional Commissioner (2), Thane Municipal Corporation, Thane to Deputy Commissioner, Thane Municipal Corporation, Thane, informing him that the election which was scheduled

5-PIL-37-2025.doc to be held on 11th April, 2025 has been postponed. The aforesaid communication is taken on record.

In view of the aforesaid submission, learned counsel for the petitioners submits that he does not want to press the PIL petition. Even otherwise, there is no element of public interest involved in an election of Town Vending Committee of Street Vendors, as aggrieved persons are in a position to take recourse to such remedy as may be available to them in law. 4.

In view of the aforesaid submission, keeping the issue with regard to validity of the final voters' list open to be agitated in an appropriate proceeding, the PIL is disposed of. (M. S. KARNIK, J.) (CHIEF JUSTICE)
