The petitioner no.1 is a student who is prosecuting a law course, whereas petitioner no.2 claims himself to be a social activist. The petitioners, in this writ petition, have assailed the validity of the action of respondents in awarding tender to one BSA Corporation Ltd. for providing mechanized cleaning services in hospitals and primary health care centres by Joint Director (Procurement Cell) Health Services, Mumbai. 2.

Facts giving rise to filing of the PIL, briefly stated, are that notice inviting tender was issued on 21st June, 2024 inviting request for proposals for mechanized cleaning services in hospitals and primary health care centres for a period of five years in Thane, Pune, Kolhapur, Nashik, Chatrapati Sambhajinagar, Akola, Latur and Nagpur. The

3-PIL-52-2025.doc petitioners, admittedly, did not participate in the aforesaid process of notice inviting tender. On 21st September, 2024 work order has been issued in favour of one BSA Corporation Ltd., by which it has been awarded contract for a period of five years.

We have heard the learned counsel for the petitioners at length and have perused the averments made in the PIL carefully. The PIL does not contain averment that any of the unsuccessful tenderers is either illiterate or is so poor that he/it is unable to approach this Court in case he or it is aggrieved by the grant of contract in favour of BSA Corporation Ltd. It is also pertinent to note that the petitioners have not impleaded the BSA Corporation Ltd. as party-respondent in the PIL.

We find that there is no element of public interest involved in the instant PIL. The PIL appears to be a sponsored one. We, therefore, are not inclined to entertain the PIL. However, it is clarified that issue with regard to grant of tender in favour of BSA Corporation Ltd. is kept open to be agitated at the instance of an aggrieved person. 5.
