In this petition which has been filed as Public Interest Litigation, the petitioner has challenged the validity of the order dated 12th June, 2024 by which land admeasuring 2.33 Hectare situate at village Bhoirgaon, Taluka - Bhiwandi, District - Thane has been allotted to respondent no.10 for construction of warehouses. Learned counsel for the petitioner submits that the land to the respondent no.10 has been allotted without any advertisement and on a throwaway price. 3.

Issue notice to the respondents.

Learned Additional Government Pleader appears for respondent nos.1 to 9 and waives service of notice. Mr. Samant, learned counsel, appears for respondent no.10 and waives service of notice. Learned counsel for the respondents pray for and are granted four weeks' time to enable them to file affidavits-in-reply.

Learned counsel for the petitioner invited the attention of this Court to prayer clause (G) and submits that respondent no.10 be restrained from carrying out any construction. 6.

In response to the aforesaid submission, learned counsel for the respondent no.10 submits that presently respondent no.10 has not commenced the construction work. 7.

The aforesaid submission is placed on record. 8.

Let construction be not commenced till the next date of hearing.
