Merely because some of the conditions incorporated in the order dated 4th February 2021 in Writ Petition (St) No. 96276 of 2020 are not complied with, it cannot be inferred that an issue of public interest shall arise in the case.

However, taking note of the statements made on affidavit by Mr. Stalin Dayanand aged about 64 years and who claims that he is the authorised representative of Vanashakti, a Public Trust, we permit the petitioners to approach the Principal Chief Conservator of Forests, Government of Maharashtra with a detail complaint supported with documents as regards breach of the undertaking given by the Kharghar Vikhroli Transmission Limited and noncompliance of the conditions incorporated in the order dated 4th February 2021 followed by the order dated 9th January 2023. If any
12-PIL.101.2025.doc complaint is made by the petitioner-Trust, that shall be taken note of by the Principal Chief Conservator of Forests, Government of Maharashtra and be decided within six weeks thereof, giving an opportunity of hearing to the Kharghar Vikhroli Transmission Limited before a final decision is taken on the complaint. 3.
With the aforesaid direction, Public Interest Litigation No. 101 of 2025 is disposed of.
