Mr. Kulkarni, the learned Counsel for the applicant, on instructions seeks leave to withdraw the application. 3.
Mr. Kulkarni further submits that in the impugned order the learned Civil Judge has made certain observations regarding the bona fide of the action and good faith of the officers and the employees of the village panchayat. Those observations were not warranted for determining the application under Order VII Rule 11.

The Court considers it expedient to clarify that the learned Civil Judge would not be influenced by any of the observations in the impugned order regarding the bona fide 1/2

With the aforesaid clarification, the application stands dismissed.
