Heard the learned Counsel for the parties.

Learned Counsel for the Applicant, on instructions, seeks leave to withdraw the application with liberty to file an application before the Municipal Commissioner under Section 105B(6) of the Mumbai Municipal Corporation Act, 1888. Mr. Saraogi submits that, a limited protection be granted to the applicant to facilitate him to move the Municipal Commissioner under Section 105B(6) of the Act, 1888.

Learned Counsel for the Corporation informed the Court that the application for transfer of the premises preferred by the applicant was processed by the Municipal Commissioner and the Applicant was directed to comply with certain conditions which the applicant has yet not fulfilled. 4.

The Application stands disposed with liberty to the applicant to make an application under Section 105B(6) of the Act, 1888. SSP 1/2

To facilitate the applicant to move the Municipal Commissioner, no coercive action be taken against the applicant for a period of four weeks from today.
