Applicants are defendant Nos.4 and 5 in Reg. Civil Suit No. 359 of 2024 filed by Respondent No.1 - sole Plaintiff. 2.

Revision Applicants filed Application Exh. 55 under Order-7, Rule-11 of the Code of Civil Procedure, 1908 ('CPC' for short) seeking rejection of plaint. By the impugned order dated 05.02.2025, learned Civil Judge Sr. Division Islampur has rejected the said application.

Learned counsel for the Revision-Applicants states on instructions, that Revision Applicants do not wish to press this Revision Application, however, Shailaja

14-CRA-230-2025.doc seeks liberty to file a fresh Application under Order-7, Rule-11 of CPC contending that bar under section 181 of Village Panchayat Act is applicable. 4.

It is not disputed that the said objection was not subject-matter of Application Exh.55 and was not considered in the impugned order. Therefore no liberty is required.

Considering the submissions, Revision Application is disposed of as withdrawn.

Needless to mention that if fresh Application (as indicated above) is filed, Respondent/Plaintiff shall be at liberty to file reply to the same and said Application shall be decided in accordance with law rival contentions of both the sides in that regard are kept open for decision in accordance with law.
