Learned counsel for the applicant on instructions seeks leave to withdraw this civil revision application with liberty to raise objections at the time of settlement of issues and in the trial. Leave granted with liberty as prayed.

It is clarified that the observations and the findings recorded in the impugned order are limited to the extent of deciding the application under Order VII Rule 11 of the Civil Procedure Code, 1908.

All rival contentions of the parties on merits of the suit are kept open.
