Mr. Haridas, learned Counsel appearing for the Applicants states that he has instructions to withdraw the Civil Revision Application.

Mr. Haridas, learned Counsel further states that the Applicants be granted time of 10 days to vacate the suit premises. Learned Counsel further states that the Applicants are in possession of the suit premises and no other persons are occupying the same. All these statements made by Mr. Haridas, learned

Counsel, on instructions of the Applicants, are accepted as undertakings given to this Court.

In view of the above statement of the Applicants which has been accepted as undertaking given to the Court, the Applicants are granted time to vacate the suit premises till 12th October 2025. 4.

It is made clear that, if the Applicants fail to vacate the suit premises and if any third party is occupying the suit premises, then in that case, the Court Receiver High Court, Bombay will be appointed with respect to the suit premises to take forcible possession either from the Applicants and/or any third person occupying the suit premises. For that purpose, the Court Receiver, High Court, Bombay is required to be directed to take assistance of the Police Personnel, if required. This order will be necessary as in this case the execution of decree is being obstructed on number of occassions.

Accordingly, the Civil Revision Application is allowed to be withdrawn and dismissed as such.

Stand over to 16th October 2025. To be listed under the caption of "reporting compliance".
