1) The Court Receiver has filed Report seeking clarifications in respect of the premises in possession of Smt. Pallavi Sawal, Mr. Sanjay B. Kanojiya, Kartiki Akshay Dawre (Mr. Sanjay R. Parab) and Mr. Kishan D. Patil. 2) It appears that multiple tactics are employed to frustrate execution of the decree. Disputes are sought to be created in respect of identity of premises or deliberately some other persons are shown to be in occupation. 3) It appears that the aforesaid four occupiers have created disputes about the identity of the premises in their possession. In my view, the dispute relating to identity is totally irrelevant.
On account of repeated orders passed by the Court, the position is now clear that no occupant can occupy any premises in the constructed portion of the suit property in respect of which eviction decree has been passed. All objections of obstructionists have already been rejected. 4) In that view of the matter, the Court Receiver shall forthwith take possession of all premises to be found in possession/occupation of Smt. Pallavi Sawal, Mr. Sanjay B. Kanojiya, Kartiki Akshay Dawre (Mr. Sanjay R. Parab) and Mr. Kishan D. Patil. If any resistance is offered by the aforementioned persons for taking over possession of the premises in their occupation, the Court Receiver shall proceed to take forcible possession from them. The local Police Station is directed to provide necessary police assistance to the Court Receiver.
5) If the premises are found locked, the Court Receiver shall proceed to break open the lock and take possession. The Respondents-decreeholders shall assist the Court Receiver in identifying the premises of the above mentioned persons.
6) Additionally, it is also directed that in the event any other person claims occupation of Unit-D/11, Gala No.1, Unit No.A/11 or A/14, the Court Receiver shall take possession from those persons. 3 of
