Heard the learned Counsel for the Applicant.

When the Court expressed its disinclination to entertain the application, learned Counsel for the Applicant seeks leave to withdraw the application. Learned Counsel, however, submits that the issues as regards the court fees and the tenability of the suit be directed to be settled and decided by the trial Court.

The Civil Revision Application stands dismissed as withdrawn. 4.
The Trial Court in the light of the pleadings in the written statement, is requested to settle and decide the issues of correct valuation of the suit claim, payment of proper court fees and the tenability of the suit in the present form, without the prayer for possession of the suit property. The Trial Court is SSP 1/2
10 cra 612 of 2025.doc requested to decide the aforesaid issues alongwith the other issues which may arise, on their own merits and in accordance with law, at the final adjudication of the suit.
