Heard the learned Counsel for the applicant.

The learned Counsel for applicant submits that, though the Court had expressed its disinclination to entertain the application, he had not sought leave to withdraw the application, and, Para Nos. 2 and 3 of the order dated 23rd December, 2025 be accordingly corrected.

The learned Counsel for applicant submits that, he had no SANTOSH SUBHASH KULKARNI Date: 2026.01.08 10:07:15 +0530 SANTOSH SUBHASH KULKARNI instructions to make the statement to withdraw the application. 4.

After hearing the learned Counsel for the applicant, this Court had expressed its disinclination to entertain the application as, in the circumstances of the case, the Court was of the view that, the issues regarding court fees and the 1/2 SAINATH

902 CRA 612.25.DOC tenability of the suit were required to be settled and decided by the Trial Court.

In view of the submissions made today, Paras No. 2 and 3 of the order 23rd December, 2025 be substituted as under:- "2.

Having heard the learned Counsel for the applicant, the Court is disinclined to entertain the application as the issues regarding the court fees and tenability of the suit are required to be settled and decided by the Trial Court."

The Civil Revision Application thus stands dismissed."

Rest of the order remains unaltered.
