OCTOBER 06, 2025 ORDER :- Heard Mr.G.K.Naik-Thigale, learned counsel for the petitioner. He was at pains to demonstrate that the contempt demonstrated in the Contempt Petition is nothing but the third instance of the grave contempt at the hands of the respondents. He submits that the contemnors/respondents, by executing the mortgage deed, in disobedience of the orders passed by learned Arbitrator as also the order of this court in Contempt Petition No.221 of 2025, has committed grave contempt in view of the Contempt of Courts Act. He would further submit that the money, which is the subject-matter of the main arbitration, belongs to the poor farmers, who are the real stake holders and that the contemnors, without paying any heed to the order passed by learned Arbitrator and this court, has continued to create the third party interest by executing the mortgage deed for third time.

In view of the above, issue notice to the respondents, returnable after four weeks. In the meanwhile, the petitioner may take recourse to any permissible mode of private service. Place the matter after service is complete.

Learned counsel for the petitioner seeks permission to amend the title clause by deleting the name of respondent no.21 from the array of the parties. Permission granted at the risk of the petitioner. Amendment be carried out forthwith. [AJIT B. KADETHANKAR, J.] KBP
