IN THE HIGH COURT OF JUDICATURE OF BOMBAY

BENCH AT AURANGABAD CONT. PETITION NO. 1092 OF 2025 IN WP/10560/2023 Nilima Mohan Kadam ....Petitioner

VERSUS

State of Maharashtra .....Respondent Mr. P. S. Mantri, Advocate holding for Mr. P. V. Barde, Advocate for the Petitioner.

Mr. G. A. Kulkarni, AGP for the State.

Mr. A. D. Aghav, Advocate for Respondent Nos. 4 to 6. CORAM : KISHORE C. SANT AND VAISHALI PATIL-JADHAV, JJ.

DATE : 23rd DECEMBER, 2025.

PER COURT :

1.

In this Petition, contempt is alleged of the orders dated 29.09.2025 passed in Writ Petition No. 10560/2023 filed by the Petitioner. This Court, by order dated 29.09.2025 directed the Respondents to file affidavit-in-reply and till the next date the communication impugned in the Petition was stayed. It is alleged that inspite of the said order, the Respondent issued communication dated 11.12.2025 calling for verification of the certificate and to appear before the Medical Board. It is alleged that by this, there is contempt committed by the Respondents.

- 2 - cp1092.25.odt 2.

During the course of hearing, another communication dated 22.12.2025 is brought on record wherein the communication dated 11.12.2025 is withdrawn.

3.

The learned Advocate for the Petitioner thus submits that the purpose of the Contempt Petition is served. Learned Advocate for Respondent Nos. 4 to 6 submits that by communication dated 11.12.2025 no contempt is committed. The Petition is misconceived and deserves to be dismissed.

4.

This Court finds that since the Petition is filed on the basis of communication dated 11.12.2025 and since the same has now been cancelled, this Court need not go into the question as to whether contempt is made out or not. Since the purpose of the Petition is already served, Contempt Petition stands disposed off. (VAISHALI PATIL-JADHAV) (KISHORE C. SANT) Judge Judge dyb
