Applicants seek to condone the delay in setting aside abatement and in bringing legal heirs of deceased applicant no.1 - Annaguru s/o Jayram Borade on record. The legal heirs are necessary parties. The cause of action survives as against them. There are no malafides on the part of the applicants to approach this Court belatedly.

The delay of 850 days shall stand condoned and abatement shall stand set aside. Both the parties shall be at liberty to bring legal heirs of deceased applicant no.1 on record. The legal heirs of deceased applicant no.1 have already been shown in the title clause of the First Appeal. Both the parties shall be at liberty to carry out amendment for bringing those legal heirs on record.
