IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD 910 CIVIL APPLICATION NO. 106 OF 2026 IN WP/14146/2025 RAJU MOTILAL GIRBONE

VERSUS

THE STATE OF MAHARASHTRA AND OTHERS ...

Mr. Boinwad Omgashad B., Advocate for Applicant Mr. S. P. Sonpawale, AGP for Respondent-State ....

CORAM : SANDIPKUMAR C. MORE AND ABASAHEB D. SHINDE, JJ.

DATED : 09/01/2026 P. C. :

1.

Learned counsel for the applicant/petitioner and learned APP were heard in the Writ Petition No.14146 of 2025, wherein the petitioner has challenged the invalidation of his caste claim. This Court, by order dated 26/11/2025, had directed the employer of the petitioner not to take any coercive action against him. 2.

Today, learned counsel for the applicant / petitioner submits that despite the aforesaid order passed by this Court restraining the employer from taking coercive action, the employer has passed an order dated 07/11/2025 terminating the services of the petitioner solely on the ground that the petitioner has failed to produce a caste validity certificate. In view of the same, issue notice to the respondents, returnable on 30/01/2026. 3.

Learned APP waives service of notice for respondent-State.

2 910 CA 106-26 4.

Considering the fact that this Court has time and again taken the view that the services of the petitioner cannot be terminated solely on the ground that his caste claim has been invalidated, we are inclined to grant interim relief in favour of the petitioner. Hence, till the next date, interim relief is granted in terms of prayer clause (B) of Civil Application No.106 of 2026.
