This is an application for condonation of delay of 589 days in preferring the application for setting aside the abatement order, thereby restoring the Writ Petition (Stamp) No.37822 of 2023. Learned Advocate for the Applicant seeks condonation of the said delay. 2.

Considering the averments made in the application, I am of the considered view that the delay was properly explained, therefore, the delay of 589 days is condoned, subject to payment of costs of Rs.5,000/-. The amount of cost shall be deposited within two weeks and after that the same be transferred to the Cancer Hospital, Aurangabad.

Necessary amendment to be carried out within three weeks from today.
