Applicants seek condonation of delay of 3268 days caused in preferring the First Appeal. Learned counsel for the applicants submits that for the reasons stated in the application, the delay deserves to be condoned. Applicants are ready to give up the interest and statutory benefits for the delayed period.

Learned counsel for the respondents opposes the application on the ground that there is no proper explanation for the delay. 4.
The averments in the application are not controverted. There are

For the reasons stated, the application is allowed. The delay is condoned on condition that the applicants shall not be entitled to the interest and statutory benefits for the delayed period. Office to register the First Appeal. Civil Application is disposed of.

Applicants shall pay deficit court fees within two (2) weeks from today.
