In respect of Civil Application the copies of the same were served

to respondent No.2's Advocate. In the morning, when the matter was taken up, it was informed on behalf of Mr. M.D. Narwadkar that Mr. M.D. Narwadkar is not on the Panel of respondent No.2 now. We asked learned Advocate who was holding for Mr. M.D. Narwadkar, as to whether he has informed about the matter that would be taken up today since Mr. M.D. Narwadkar has received the copy of Civil Application on behalf of respondent No.2, he submitted the photo copy of letter given by respondent No.2 to Mr. M.D. Narwadkar. It is taken on record by marking Exh. 'X'. By Exh. 'X' it has been informed to Mr. M.D. Narwadkar that his appointment for respondent No.2 has been cancelled and it also reflected that on the same date another communication was given by respondent No.2 to Mr. M.D. Narwadkar that he should hand over the documents to the Clerk of the Board, so that arrangement can be made for representing respondent No.2. We hope that the Advocate Mr. M.D. Narwadkar would have handed over the documents to the Clerk on 23.01.2026 as per letter, however, today respondent No.2 is not represented.

Heard learned Advocate for applicant/petitioner. The petitioner is Nursing School who had filed the petition to challenge the order dated 06.01.2025 (it should be 06.03.2025) issued by respondent No.2 and also for directing respondent No.2 to enlist two students viz. Deepak Sundar

Thombre and Sushma Sudhakar Nagargoje in the list published by respondent No.2 on 11.02.2025 and declaring them as eligible for examination of First Year of GNM three years course. It appears that by order dated 25.07.2025 this Court by speaking order had allowed the two students through the petitioner college to submit their documents and other details before respondent No.2. Thereafter, it appears that respondent No.2 misinterpreted the order and again by order dated 22.09.2025 assigning further reasons directed respondent No.2 to permit the petitioner to produce physical records pertaining to two students before Deputy Registrar on that day itself i.e. before 5.00 p.m. It was also directed that respondent No.

2 shall upon verifying the record to take further steps to facilitate the two students in appearing for the examinations commencing from the next day and learned Advocate for petitioner then submits that accordingly those students were allowed to give papers. Now, the results have been declared except of those two students. Perusal of earlier record would show that this Court had not directed respondent No.2 to withhold the result of two students. Respondent No.

second year.

Here, the Civil Application was listed on 16.01.2026, but due to paucity of time it could not be taken and now respondent No.2 appears to have taken the decision to cancel the Vakalatnama of Mr. M.D. Narwadkar. We deprecate such practice, taking into consideration the conduct on the part of respondent No.2. The future of the students cannot be so withheld and, therefore, we direct respondent No.2 to declare the result of two students i.e. Deepak Sundar Thombre having Seat No.35843 and Sushma Sudhakar Nagargoje having Seat No.35844 of the First Year Annual Examination of GNM course.

We permit learned Advocate for applicant to send the authenticated copy of this order immediately to respondent No.2. Depending upon the result, two students would be then entitled to fill the form. The result be declared before 5.00 p.m.

Civil Application stands disposed of.
