Applicants seek to condone delay of 800 days caused in filing application for setting aside abatement and bringing the legal heirs of applicant No. 2 - Satyashila Nersing Dhas. 2.
The cause of action survives against the legal heirs of deceased applicant No. 2. They are necessary parties. There is no reason to doubt the bonafides of the applicants. The civil application is allowed in terms of prayer clauses 'B' to 'D'. The civil application is disposed of.
