By this application, applicant seeks restoration of the civil application by condoning the delay caused in filing this application.

Heard learned counsel for the respective parties. 3.
Learned counsel for respondents opposed the application pointing out that he has already communicated to the respondents employees that the application is dismissed for want of prosecution. The application for restoration was filed after almost one and half year. In fact, petitioner was not diligent to prosecute the matter and because of their fault the employees are not getting benefits which were ordered by the Labour Court. SVH

Considering the submissions advanced by both the sides, I am inclined to allow the application. Application is, therefore, allowed in terms of prayer clause 'A' and 'B', subject to the condition that applicant shall deposit of cost of Rs.1,44,000/- i.e. Rs.1,000/- for each of the employees. After deposit of the amount the same shall be paid to the each respondents employees. (SIDDHESHWAR S. THOMBRE, J.) SVH
