The civil application No.1152 of 2026 is filed for condonation of delay of 176 days caused for filing application for setting aside the abatement and to bring legal representatives of respondent Nos. 1-a to 1-c on record.

Perused the application and heard learned advocates for

ca1152.26 -2both sides. Considering the reasons stated in the application, it appears that the delay caused is not deliberate. Therefore, the application is allowed in terms of prayer clauses B to E. The delay caused in filing the application is condoned in the interest of justice. 3.

Amendment to be carried out within a week from today. It is clarified that if the amendment is not carried out on or before 6.2.2026, the applicant has to pay costs of Rs.1000/- to the High Court Legal Services Sub Committee, Aurangabad and thereafter to carry out the amendment on or before 13.02.2026.
