The civil application No. 1159 of 2026 is filed for condonation of delay of 90 days caused in filing application for setting aside the abatement and to bring legal representatives of appellant Nos. 6A to 6D on record.

Perused the application and heard learned advocates for both sides. Considering the reasons stated in the application, it appears that the delay caused is not deliberate. Therefore, the

ca1159.26 -2application is allowed in terms of prayer clauses B to D. The delay caused in filing the application is condoned in the interest of justice. 3.

Amendment to be carried out within a week from today. It is clarified that if the amendment is not carried out on or before 6.2.2026, the applicant has to pay costs of Rs.1000/- to the High Court Legal Services Sub Committee, Aurangabad and thereafter to carry out the amendment on or before 13.02.2026.
