Applicant seeks to condone delay of 5291 days caused in filing appeal against the award passed by the Reference Court. 3.
Applicant is litigating for just compensation towards acquisition of his land. The learned advocate for applicant, on instructions, submits that he is ready to waive the interest and statutory benefit for the delayed period.

Perused the application and reasons therein. Apparently, delay is occasioned on account of financial difficulties and lack of knowledge as to procedure of court. In that view of the matter, considering the nature of ligation, sufficient cause is made out to condone the delay. Delay is condoned subject to filing undertaking by applicant that he shall not claim interest and statutory benefits for delayed period. Such undertaking be filed within ten weeks, which shall form part of compilation of appeal. Appeal be registered subject to removal of office objections.
